Can an expungement be denied in Florida?

Yes, an expungement can be denied on two levels. First, the Florida Department of Law Enforcement could decline to issue a certificate of eligibility if the person is not otherwise eligible to have their arrest expunged. Secondly, a petition to expunge an arrest could be denied by the court in the court’s discretion, although, more often than not, petitions to expunge will be granted by the court.
