How does the judge or jury decide who to believe?

In every jury trial, there’s a standard jury instruction that’s read to the jury with various things that they are to take into account when weighing the evidence in the case. Such things as, whether the witness was honest and straightforward in answering the attorney’s questions, whether or not the witness had an interest in how the case was to be decided.

It’s important to have an experienced attorney – an attorney who’s tried a number of cases – to know how to best present a case overall in court to advance the facts that are most likely to be well-received by a jury and not advance the facts that are likely to be easily rejected by a jury.
