What is expungement in Florida?

Expungement is a process by which someone can have their arrest erased off of their record. If their case is dismissed and they have no prior criminal convictions and no prior expungements, they can apply to the Florida Department of Law Enforcement for a certificate of eligibility. If that’s issued, then the person can petition the court to have their arrest expunged, which are typically granted, but within the discretion of the court.
